I am doubtful it's just a single binary decision of legal or illegal. He used multiple methods to employ his tariffs including  IEEPA for most and Section 301 of the Trade Act of 1974. I could definitely see the scenario where the IEEPA are not seen as legal and a few others are seen as legal.

Regardless what the Supreme Court rules we are done for as the damage has been done . Counties know how the constitution reads and noting was done to stop Trump. That has proven to the world that it’s risky dealing with the U.S. because rules can change daily.

I suspect that SCOTUS might rule the tariffs illegal, potentially making many people wealthy, with some of the benefits finding their way back to the Justices. I wouldn’t be surprised if Trump or his sons ended up involved in some of the action.

This is about who can impose taxes on the American people.  There are laws that allow special presidential authority to impose sanctions or punishment on other nations in cases of national emergency, but not to impose taxes on Americans.  

I expect the SC will probably side with Trump but I'm really curious to hear how Australia (for example) is posing any national security threat to the US that justifies tariffs.  The US has a trade surplus with Australia so even that incredibly stupid argument doesn't work.

The reason that he has been able to do this so far is because of a state of emergency that should have expired 6 months ago. But The House made a rule in their own internal rules that decides that in that particular case with this particular Congress that no days will count towards the maximum number of days for Trump's state of emergency...

I forgot the part of the Constitution where one body of Congress could just pass laws on their own by changing the definition of a day in their own internal rules. Must have missed that episode of Schoolhouse Rock.

They should rule that congress (senate and house) needs to approve the tariffs with a vote.

They can't allow presidents to declair 'emergency powers' for themselves on every fucking issue with no test for if it is actually an emergency and no duration specified for that emergency.

They should rule that all emergency powers last exactly 30 days like the emergency power duration for sending in the national guard.

30 days is plenty of time for congress to vote on making those powers more permanent if they are warrented.

Since it's absolutely clear in the written law that this is not a presidential power, but belongs to congress, if they give this to Trump anyway without requiring at least a congressional vote, then they will have caved in totally, and Trump will be a stronger king than Henry the 8th.
